A Man in Chicago is sueing Microsoft for developing a defective concole system.

xbox had already announced they had a 15% deficiency rate with the new consoles
the man wont win this case, its a new console, new design, things are bound to go wrong. the man obviously doesnt have a life if he is suing over a minor problem when he just could have sent it back and gotten it repaired.

Its a mixture of the early release and the stupid people who buy it as soon as it comes out.

Yea thats why they're realesing the PS3 later so they can make sure there's no glitches. But Microsoft just wanted it on shelves by the holidays.

I like how everybody has turned this into a consol war. It's sad to think that some people actually think this is a good idea based souly off the fact that they personaly prefer Nintendo more. And we wonder what's wrong with the world...

This case is shit. Microsoft has already said that they'll fix the problems overnight or send you a new one right away. The only way this case is going to stand is if he can prove, beyond a shadow of a doubt, that Microsoft was 100% aware of the problem but sold the consols anyway in order to get them on the shelf first. But without any documents or emails saying that, he'll never be able to prove it. He's just a loser looking for an easy way to make a quick buck.

His only other option at winning would be if Microsoft had refused to fix the issue. But, as I said earlier, they've already said to send them in and they'll be fixed free of charge. It's a bullshit case and waist of tax payers money and the judicial systems time.

The only real crime here, is that the asshole who filed the suit to begin with, isn't already dead.

I don't understand that this man is suing over. Unless he opened it up and attempted to fix it himself the console is still under warranty, just send it back and get it fixed. What additional damages beyond the the cost of the console could he possibly be suing Microsoft for was the mental trauma of losing his save data really that bad.. Good for him though, clogging up our legal system for some cash he didn't earn and doesn't deserve.

He is the one who should be sued because of the fact that he bought a Microsoft product on it's first shipment

Yeah, this case is stupid. When the consoles come out for any company, they always have problems. always. But later, they fix them and thats when you should buy them. Plus, this guy probably stuffed the Xbox in some sort of closet or something so it would overheat and he could sue.

I agree. Of course he has every right to sue them, they're selling garbage. I was never a fan of XBox anyway, because I know how unstable a lot of Microsoft's software is already. Why would I pay several hundred dollars to be absolutely STUCK with their OS?

I mean, he should've expected it to be very unstable because it's produced by the same people who made Windows 98 (lmfao @ Win98) and even other stability flaws in XP. However, just because Microsoft sucks doesn't mean it gives them the right to sell shitty products.

I hope that Ps3 won't be like this, crappy microsoft hardware.
