I would suggest that the rule should come into effect a few minutes after the game gets uploaded as it's not unreasonable for the posting party to go ahead and attempt to try to run the game that they put effort and pride into making themselves and seeing that it does not work they have a drive/desire to pull it down and attempt to fix the issue and then re-upload it
if that happens then the flag nulls out, and it doesn't go into the Obituaries

I understand the desire to assist users/people in the creation method, the testing phase and that we can't be hasty in the desire to just blam or take an item down.
we deal with hundreds of games per month, and with respect to the Ruffle Testing / Flash Preservation Crew I think that we should flag the items that don't work and it can be assessed for this rule at a later time, if the user is not showing any attempt to repair, fix, change, re-upload, speak about, reply to comments, showing zero engagement then the rule should be enforced and the content removed

No I don't see it. It might be useful for "unsuitable submissions", but you shouldn't really be able to see unpublished submissions the same way.

Wait, are you asking in context of older games or games in judgement (new)?
In the terms of older games which users have not accessed their account in many years I think Tom and gang can simply decompile and recompile old flash things with that type of garbage to the support ng site.
If an aspiring new user actually has made a game, but added elements via a shady monetization service that violates NG rules, then mods should unpublish the game and send a corresponding mail about it.
