As I recall, the statute of limitations on copyright infringement is 30 years long...so if the sample is older than 30 years, you should be ok...I think, lol.
The point of this legislative position is that art is almost always derived from some other piece of art. Once a piece of art has been available for 30 years, it's considered part of the public domain to encourage the creation of derivative works.
I'm not a lawyer though, don't stake anything important on my words - look it up for yourself. Also varies by country...and legislative body...and a re-mastered or re-released piece renews the statute.
