"How" did this kind of craziness be allowed to happen in the first place?

Seriously? Trying to trademark a word as broad as "How"? What next, trademarking the word "The"?
I think "How" should be on the list of things that shouldn't be trademarked, since that will lead to nothing but confusion.

Personally I think anything which is a pre-existing word in the English language in common usage shouldn't be allowed to be trademarked, but that'd be a problem for Windows, Android, Apple, and so forth.

Yeah the system's all messed up.

Like for example, I think "Microsoft Windows" should be trademarkable, but not just "Windows"
"Google Android" but not just "Android"
"Apple Computers" but not just "Apple"
It should have to be the entire distinctive term and not just a single common English word.

That's my opinion on it anyway. Of course money, rather than logic and reasoning, is what pushes the rules through.

*trademarks (although the same applies to patents as well, though not so much to copyrights)

Because some douchebag can sue you *and win* for violating some "property" of theirs where
a) you never intended to violate anyone's property
b) everything you've done is your completely original work and/or completely independent of whatever it is they did
c) they were most likely awarded some overly-broad and/or overly generic "property" which should never have been awarded to anyone

My solutions would be as follows but unfortunately doubtful any of this would happen.
1) Eliminate patents altogether. Nothing is patentable and all existing patents are hereby null and void.
2) Limit trademarks to unique, original names. Words in a standard dictionary are ineligible when used alone, as are common phrases. This means they'd either have to combine words and/or invent new words which they then trademark.
3) Copyright hard-limited to 20 years. Everything automatically becomes public domain after 20 years.

I'd rather wait to see whether the "How" book guy wins the case before getting riled.

The trademark system would clearly be ridiculous if he is successful. Otherwise it works since people can assemble a case stating you can't claim a breach from a commonly used word with a variety of usages.

Fun fact: Uncopyrightable (a word this very much falls under the remit of) is the longest word in the English language which does not use any of its letters more than once.

Another fun fact: The above sentence took more brain cells to write than what was used in the entirety of that lawsuit filing.

As well as the obvious complaints of it being stupid. It is also a really bad thing for our language, as if people start being sued for using words like "how" it would end up with people avoiding using them, like people avoid singing the happy birthday song. So rather than people asking "how was your soup?" you would just get "your soup?" (obviously there are other things like "are you enjoying your soup" but as an example it shows how retarded it would be to start claiming ownership over such words as it would only begin to narrow down the language until we begin to lose many of the perfectly good methods of asking questions.
