YAY GO CANADA

By constitutional steps Canada has brought about it's independence. The Statute of Westminster of 1931 was the first step, as "it invested Canada with full international sovereignty and formally sanctioned Canada's accession to independence, except for the amendment of certain provisions in its Constitution." (Trudeau, 1978) The procedure for the amendment of the Constitution was not adequately defined in our constitutional enactments and still required, for certain matters, the intervention of the British Parliament until the repatriation of our Constitution in 1982. This was something Pierre Trudeau was responsible for and only one of many reasons Canada honoured him when he died. His vision of the repatriation of our constitution began with his dissertation: Time for Action, written in 1978, whereby the move towards the Canada Act of 1982 promised to "reaffirm the independence and full sovereignty of Canada." In this dissertation he wrote:

To complete the renewal of our Constitution, two further things will be required: an Amending Procedure, and the Patriation of the Constitution. It is essential that agreement be reached at an early point on a procedure for changing those parts of our Constitution that cannot now be amended by either the Parliament of Canada or the legislatures of the provinces. We will have to go to London for action by the British Parliament to make many of the changes that will emerge from the work of renewal. This is demeaning for an independent country, but a legal necessity since we have never remedied the omission in the legislation of 1867 to provide a complete method of amending the British North America Act in Canada.

The constitution still recognizes the Queen, and indeed, we still see her as the symbolic head of our nation, and we still have her designated representative offices: the Governor General of Canada and the Lieutenant Governor of a province. However, the passing of the Constitutional Act of 1982 included a repatriation statement, which alongside the Statute of Westminster completed our move for complete independence.
(1) Enacted as Schedule B to the Canada Act, 1982, (U.K.) 1982 c. 11, which came into force on April 17, 1982. The Canada Act 1982, other than Schedules A or B thereto, reads as follows:

An Act to give effect to a request by the Senate and House of Commons of Canada

Whereas Canada has requested and consented to the enactment of an Act of the Parliament of the United Kingdom to give effect to the provisions hereinafter set forth and the Senate and the House of Commons of Canada in Parliament assembled have submitted an address to Her Majesty requesting that Her Majesty may graciously be pleased to cause a Bill to be laid before the Parliament of the United Kingdom for that Purpose.

Be it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:

1. The Constitution Act, 1982 set out in schedule B to this Act is hereby enacted for and shall have the force of law in Canada and shall come unto force as provided in that Act.
2. No Act of the Parliament of the United Kingdom passed after the Constitution Act, 1982 comes into force shall extend to Canada as part of its law.
3. So far as it is not contained in Schedule B, the French version of this Act is set out in Schedule A to this Act and has the same authority in Canada as the English version thereof.
4. This Act may be cited as the Canada Act, 1982.

The Canada Act of 1982 set the Canadian legislative bodies (House of Commons & Senate alongside Provincial representation) as the sole executors of Canadian rights and freedoms as well as control over changes and provisions in our Constitution.
