Do i have a legal leg to stand on?

Let this thread be a warning to every one about signing personal training contracts with good life fitness,

I have many questons and comments to make about GoodLife, I am pissed the fuck off and this will mostly help me vent and perhaps get some experiences from the lovely users of newgrounds to entertain me,

The date was early Aug, My roommate excitedly calls me up after he was in an encounter with a GoodLife fitness personal trainer sales person.

We where saving over $5000 bucks he said, we can get out of the contract any time he said.

So i was enticed to go down to the gym and check this out. I am out of shape and thought this would be a great oppertunity,
The rep was very nice, He said several times that we could quit any time, I was skeptical and made sure to ask him several times inbetween his overly excited sales pitches, I have the whole conversation recorded,

He slides a pink contract to me, I start reading it when he tells me that he is late for a training appointment, I told him i could just take it home and read it there, he told me not to worry about it as i can back out at ANNNNYY TIME!#*$

So i skimmed it, and signed right under * i AGREE THAT THERE ARE NO VERBAL AGREEMENTS, ONLY WHAT IS IN THIS LEGALY BINDING CONTRACT.

Well I asked for a copy of the paper i just singed, He said it would take 3 weeks to get a copy from head office,
I told him to photocopy it and he said that it was against polocy to photocopy the origional and i would have to wait for a printed copy.
This should have raised a giant red flag, but i was excited to get such a service for only $2300 bucks,

I went up front and made my 10 % deposit in cash. The recept was put with the contract, I asked again for a copy of the cash transaction when i was told there would be one with my contract that i get in 3 weeks. uhh redflag moment once again.

So 4 weeks in, I am 30 pounds lighter and loving my amazing personal trainer, I entered a letter to goodlife contest about how much i was enjoying the service, I have a chance to win my deposit back. But that night, the first payment comes out....

I was told the first payment would be 99 bucks, Well i had 130 in my bank account for a credit card payment and i had 99 left after that, GL attempted to take out 180 bucks and that got bounced by my bank and charged me an extra 100 bucks and a hit on my credit rateing, I demamded my contract the next day and when i got it , it was not what i signed for,

The payments would come out every week, 180 bucks a payment, for 1 year. I got into a physical altercation with the person who sold me the contract and I am now barred from finishing my sessions, AND i get a phone call from my bank 3 days later saying i defaulted on a 13000$ loan and they would close my bank account and I had to forfit my credit card that carrys a balance of $3000 on it, Now i have 15000 bucks in collections,

I met with the local VP at goodlife HQ and he basicaly told me oh, its the same as a car loan, Just because you dont use the sessions dont mean you dont pay for them,

So here i am, Unable to pay my rent next month because i dont have a bank account, Unable to use my personal trainer because goodlife lied, I am going to starve to death if not for the local food bank, Im sure i will get denied from there because of my job, but i cant get paid for my job...

Well,, there are more details to this, I just cant get into every thing because i am mad as hell,

I am seeking legal advice later today, Ill update then, feel free to give your 3 cents on this story,

he's right, if he gave out his age, you could pinpoint his exact location, all the way down to the address of his house.

Wait a second, that's not true at all, you're just a fucking idiot.

I'm pretty sure you're 14, as your posts says you don't even have a bank account.
I am so new that I signed up 7 years before you.
And trainers as well as gyms fuck individuals all the time. Why would you pay thousands for service you could get for much less? Do you even lift?

DID YOU EVEN READ WHAT I POSTED? holy fuck reading comprehension much?

No the contract was for a small amount of money, Atleast the one i singed was, The unsinged one that they are holding me to is for about 7 times more money,

yurgenburgen

Please read the whole thing, I signed a contract for $2300, A small amount of money, I was charged a lot more. And the results speak for them selves, i was working out on my own for a year and lost 25 pounds, I had a personal trainer for a few weeks and lost more then what i lost in a year due to ineffective workout technique.

Now that the insanity is out of the way, I do have a question for you.

Did the contract in question mention anything about the actions that the gymnasium have conducted?

It mentions that there are no verbal agreements, It mentions that any price quoted vocaly is not valid,
The contract specificaly says *I confirm that no verbal representations have been made to me*
Right under that is the price of $2300, biweekly payments of $99 at an intrest rate of 29% over the year,

The unsigned paper that was stapled to my contract that i was given with the one i singed states that my financing was declined and was resubmited with new terms and accepted, The new terms are exactly 7x what I singed for, with 2 times as many sessions, I was never told about this paper. but the origonal contract states on the back that the financing can be changed at any time and my signature is applied for all future agreements.

Tell us this story in vivid detail. I want to know about the part where you decided punching him was a good idea.

I raised my voice to him when i receved my unsinged 2nd contract saying that i owe them 7 times more money because my financing was declined, he put his hand on me and told me it was time to leave. I removed his hand and pushed my finger into his chest as i exclaimed that what they are doing is down right dirty, and my lawyer will be speaking with them shortly.

This was after they told me i agreed to future contracts on the original contract.

I did not agree that I am not able to share the details of my contract, And i did not agree that if i an not satisfied with the service that I would not warn others about the dirty pool goodlife plays, People need to hear about this, its almost like a PSA, Ill bet you think twice before joining a gym and it could save you a LOT of pain and suffering,

I don't have any legal advice except go talk to an attorney. Also you should make a video and some posts on reddit etc. exposing this gym for the scam they are.

I'm going to assume that you're trolling. For one, an overdraft doesn't translate into an automatic hit on your credit score. It's only a problem if you don't resolve it.

Now, if you were telling the truth, it's really your fault. It's pretty common knowledge that huge gym chains are shady. It's also pretty well known that salespeople are scum that are not to be trusted and an oral contract isn't worth the paper it's written on.

On a side note, what's with all these kids trolling? I genuinely don't understand. What's the point of writing up some long sob story to see peoples' reactions? Why can't these kids ever seem to make the stories plausible?

And most importantly, where do kids find the time for all this copy-pasta? Don't kids have better things to do with their time? Do you not have genitals you could be abusing?

Waste of money, waste of time.

You will have learned the hard way that you should NEVER SIGN SOMETHING THAT YOU HAVEN'T HAD THE TIME TO READ!!!

You said personally in your post that YOU even thought that it was a red flag; why didn't you stop there? The second some asshole says its against policy to print a copy of the document you should have pulled chocks... Scratch that, the second someone says that you can't read over the fucking thing you need to say fuck it.

The whole gym memberships/personal trainer shit is such a sham. If you really want to lift something heavy, come over to my house and move some furniture around for a couple hours; then run your ass to the market and pick up my dinner. You don't need to pay some asshole to say "don't eat this" or "you need to do more cardio", you know as well as I do that you KNOW you shouldn't be eating what you want to eat or you should be off your ass and walking around the block: ITS NOT ROCKET SCIENCE. Its time you stop blaming other people for being incompetent.

If you are coming onto New Ground (of all places) searching for sympathy to a fool; you've made another horrible decision. If you came to New Ground seeking legal advice; you've made, yet again, ANOTHER horrible decision. I think its time you rethink your life, someone is trying to tell you something.

If this story is credible then think of this as a learning experience for you and a teaching experience to others that took the time to read this anecdote.

Never sign something you aren't fully comfortable with, its as simple as that.

A legal consultant, lawyer, judge, etc, will tell you the same thing except in nicer words. The world is a fucked up place. Its time you learn that and better prepare for the shit to hit the fan.

And with that I will close with one of my favorite quotes:
No matter how messy things get, it can always been cleaned up.

They can't hold you to a contract that you didn't sign. Take them to court if it comes to it, and be more careful in the future about getting a copy of the one you signed. If someone says that it will take three weeks to get a copy, they're lying, because it's no trouble to fill out duplicate forms.

You should also check if there are any class-action suits against GoodLife right now, they're actually pretty well-known for ripping off customers, overcharging, and creating huge problems when people try to cancel their memberships.

No, he signed one rate, and they claim to have applied his signature forward to any new rate they choose. The legality of a clause like that is questionable, especially since the guy at the desk misrepresented the contract to him.

Yes, it was dumb to sign the original without reading everything, but it's not as if there's no legal recourse possible. I'm trying to be somewhat helpful here instead of giving advice that can only be applied in the past.

Thankyou for making one of the only helpful comments of the day, wow this comunity has gone downhill hard sense 02-05...
thanks for the responses other guys who are not totaly illiterate and bothered to read, and not troll,

I talked to a lawyer for free today, He took a copy of the conversation i had with GL and the contract, He said i would be best off taking them to small claims to have the contract abolished, If they find that the contract is legal, then the most i can recover is 5k as that is the provincial maximum,

I am sereously bummed right now, But chances are that the contract is not legaly binding.

The lawyer is also going to cost me about 12% of the contract if i win the case... every one got their hands in my pockets and they are pulling out lint.

and to every one bitching about age.... you do realize you must be 18 or older to enter in a contract right? and 19 to own a credit card.... And i own a fucking $4000 synth that you can see on my profile, you guys iz dumb or trollin, successfull troll iz sucess.

There is plenty of proof in this post,

I simply don't like my age being a factor in conversations i have with people, So i used an OBVIOUSLY fake age of 13 after I singed up as people where making comments about my maturity levle for my much older then average age for this site, I have been coming here from late 99, of course I " outgrew" the average user, that should not bar me from having fun on the site and posting about silly things. having a low age brings less attention in the average immature thread then being an old fart making cock jokes,
