Actors have died before. Loads of them have died. If every major actior that died were given an Oscar for the "illusion of being noble", there probably wouldn't be room for live actors in the contest (and possibly suicide rates with movie starts would go up).

I mean,t he oscars haven't even been awarded yet, why are you all acting as it is already a fact and automatic? If he gets it, it'll be the same reason he was nominated, the Oscar committe thought his perfomance was worth it.

Heath Ledger was amazing in that movie. That was what got him the nomination. Not the fact that he died right after filming. He did everything great, from the "Why so serious?" part, which now has its own little meme, to the evil laugh. He totally deserves to win.
