Not unless they have physical evidence. We tried to get a guy at my work arrested for stealing shit we know he took, but since it wasn't caught on camera the police and the company both say we can't charge him.
Ya, unless they got evidence, they can't do anything. But if they do, even for the first time as long as it wasn't too long ago, they can still get you.

I believe that the statute of limitations for misdemeanors (I'm assuming you weren't swiping cars) is 2 years in most places. For felonies its even longer.
So if they discover any evidence between now and 2 years from now, your butt's going in the slammer.
If you commited a crime more than five years ago, then you're free
However, like everyboy else said, it might be hard to prove without actually finding the items, for which they'd need a search warrant, which they probably wouldnt do, as they get loads of call about shoplifting
First off your friend is really dumb to begin with for stealing but stealing from the same location twice just adds another level to their stupidity. And second, if they have evidence that points to them as the thief from the first time and take it to the police then they have grounds to prosecute them. The level between a misdemeanor and a felony depends on the value of the items stolen so if they stole some really valuable stuff, they're going to be in jail for quite a long time.

Possession of stolen property is still a crime. they can probably tag you for stealing the other things if they catch you this time.
