But these people manage to play these leaks without any trouble and account suspensions from one simple thing. Unplugging the network cable. When the game comes out they probably delete the game if they so choose to purchase the game. I'm not familiar with how Microsoft runs bans but how can they possibly tell who is pirating the game? Unless it's hidden away in their T&A they can't tell who's playing what when they're offline.
Of course if they had their network cable still stuck in, and playing whatever game much earlier just to tell their buddies they have the game they're fucked.

This isn't entirely true. If you unplug the cable you are just safe until you decide to plug it back in. All the data is stored on your Xbox 360, once you plug that cable back in all that data will upload online and they will be able to see what games you have played, and when you played them. Also, if you've been playing the game offline the entire time, the game shows up as "Never played online." You can even see that at Xbox.com. If you look at some of these guys profiles who have been playing Saints Row 2 or other early games, a lot of times those games show up as "Never played online" while every other game of theirs has been played online. These are the guys who are unplugging their cables when playing pirated games.

There's no possible way to delete the history of what has been played on your 360. But, it's not early copies that get people caught and banned. Nobody knows exactly how MS detects modded hardware, but most people believe it has to do with playing unsafe games. I know people who have been playing on modded consoles for over two years, unbanned, because they avoided taking unnecessary risks like playing builds of games that aren't the retail version. I don't think it's easy for MS to track down modders, I think the only ones who get caught are those that play unfinished game builds and badly ripped games.
But yeah, playing offline is only safe until you plug the cable back in.

I just asked a friend if he could check for me, he has an account at Black-Cats. He said the only copy of Fallout 3 they have is the Seed4me release, which is the review copy.
Plus, usually you can find games on usenet before torrent sites like Black-Cats, and usenet only has the Seed4me release too.

I think that if Microsoft catches you playing pirated games, your whole console is banned from the service.

This isn't how it works guys.
First, if you get caught you get your Xbox banned, that's it. Your gamertag and all achievements stay, you are just never able to log online with your Xbox 360 again. The only thing you can do is buy a new Xbox. All you have to do is throw down $200 and get an Arcade version and swap your harddrive back and forth between the two when you want to play your modded games offline, or real games you own online, assuming you get banned and have to buy a new 360.
Second, playing on a guest account won't make a difference. Every bit of information is tied to the console itself. Every console has it's own serial number, and they track modders by that. If you unplug your ethernet cable, create an alternate account and play the game offline, your 360 is still gathering information. Once you plug that 360 back in and go online, the data that was stored is uploaded to the Microsoft servers. So if you played a badly ripped game or an unfinished game, that information is going to stay on your 360 no matter what you do, and once you go online MS can see it.
That's why there's a good chance these people playing review copies are going to be screwed. Reviewers play these copies of games on debugged consoles, so when all of these people who played offline finally log back on, it's going to show that they were playing a review copy game on their normal 360, and that's all Microsoft needs to throw out some bans. It happened with Halo 3, I'm sure it'll happen again.

Hm, unless your console actually records when you first played the game, wouldn't all these guys need to do is stay offline until Fallout 3 comes out?
I won't look at the vids out of sheer spite for being surprised by a game.
I'm really looking forward to this game because I was one of those people who played Oblivion and went, "Man, I really wish I could shoot somebody;" and behold, Fallout answered my call.
And, as a general note, I've always enjoyed the post-nuclear war/ end of the world style games, there's something very epic about all of that.
I'm gonna go back to my room and be awesome.

Even if it was a pc release, pc gaming wouldn't die.
Shit always going to get stolen etc(pirated)for ever games have been pirated, but luckily there are still those few who feel its better to actually pay for the product.
