I have seen tons and tons of flashes like that. Take that one Sonic RPG thing with the crappy spelling, and unscripted fighting. (I'm not saying the series sucks, but the earlier part does.) Anyway, its sprites are clearly traced.

So the question I have is; Do you have to give credit for something you traced, like a pic online you outlined with a paintbrush or something? Or is it considered yours?

I never credit for tracing, but then again I get my images from al over the web. I can't really remember where I get the pictures from. If you're using ripped or custom sprites though, there's a chance that the guy making them asks for credit. so give credit =P. I used 3 traced guns for the background of my sniper game tutorial, and got away without giving credit then.

I used 3 traced guns for the background of my sniper game tutorial, and got away without giving credit then.

But take this for example. A guy traces the Mona Lisa. Does he have to say, "I give credit to Leo for Drawing the origional"? Does he have to pay royalties?

How could he pay royalties to a dead guy?

I'm not really sure about royalties and all that. Not 100% sure, but as long as you don't make profit, you should be fine...

if you trace something like a gun and totally change it (like size colour scheme etc) then yes, it is considered your own work in almost all cases but if you are using sprites etc like how everyone does:
Say you are making a sonic rpg replica thing it is actually ILLEGAL!
even if you say "Copyright NINTENDO" in most cases it is still ILLEGAL!
but I dont think you need to worry since Nintendo is raking in enough $$$ as it is

like i said before, because Nintendo doesn't give a urinating-mario about who is using the stuff unless they are making big bucks out of it :P

What if you are making a mario game on your own work, no sprites etc, and scripting youur own work?

If say, you have to pay Nintendo, could u change the game so everything technically isn't technically Nintendo? Like, instead of brown/black hair, change it to blue, and instead of calling him Mario, call him Marjo? This is all hypothetical btw.

With the Nintendo example, as long as you are not making any money, you've really not done anything wrong.
