Judge: No Psycho-Sexual Test for Green

PROVO -- A judge
ruled Wednesday that
avowed polygamist Tom
Green will not be forced
to submit to a
psychosexual evaluation
before he is sentenced in
August for bigamy and
criminal nonsupport.
Green had argued the
test would violate his
religious beliefs against
exposure to pornography.
The evaluation uses a device that measures sexual arousal while someone
listens to an audiotape describing various erotic situations.
After listening to an hour of arguments, 4th District Judge Guy
Burningham ruled that Green's discomfort with the test outweighs the
benefits to the justice system.
"It probably would be quite intrusive and it may subject Mr. Green to
things that would be quite unpleasant," he said.
Juab County Attorney David Leavitt had demanded that Green submit
to the evaluation in advance of the polygamist's Aug. 24 sentencing on
four counts of bigamy and one charge of criminal nonsupport, all
third-degree felonies. He was convicted last month and faces up to 5
years in prison on each conviction.
But defense attorney John Bucher countered that Green was not
convicted of a sex offense and, therefore, should not be forced to
undergo the test.
The most controversial element of the test includes a machine called
the plethysmograph. The machine uses a stretchable band fitted around
the subject's penis to measure any changes in size. The person then looks
at pictures or listens to audiotapes depicting various sexual scenarios and
arousal is measured.
The test is most often used on convicted sex offenders to create
sentencing recommend- ations.
Bucher said Green was uncomfortable being exposed to pornography.
Subjecting some- one to the material against their will violates constitu-
tional rights against cruel and unusual punishment, he said.
Leavitt countered that the test was requested by Adult Probation and
Parole, the agency that is preparing Green's presentence report, which
provides background information on a defendant and recommends a
sentence.
Leavitt said it was important for the judge to see a complete picture of
Green before sentencing. He argued Green had married the women when
they were in their teens, one as young as 13.
But outside of court, Leavitt said he had no problem with the ruling.
"It's not an issue of disappointment, we simply wanted to aid the court."
Green, flanked by two of his five wives and his 30th child, said he was
pleased. He said an independent psychologist hired by the defense
determined he is not a pedophile.
Green added that even if not taking the test eventually comes back to
harm him in sentencing, he still did want to submit to it. "I'm not a sexual
deviant," he said. "I've created a family; it's not some kind of sexual
organization. I don't think a family man should have to go through a test
like that."

Shrapnel: You have to wonder who is the sick one in that story. It's pretty bizarre.

I'm pretty sure the one who gets to slip the band on the suspect's penis is related to the one who made the device.

It really really reminds me of Clockwork Orang where the guy is forced to watch clips of violence and sex.
