Jails are operated by local officials and their primary function is to hold people who are awaiting trial or are convicted of misdemeanors, plus they house both men and women in different wings. It's just a common practice in the US. As far as I know, he didn't do anything that serious, so the judge is allowing him to get his things in order before reporting to jail.
