Neighbor shoots and kills robbers.

This article is about some guy in Texas who shot two and killed two burglars robbing his neighbors house. Now the problem is that the burglars posed no actual threat to the man, which is why he is on trial for the murder of the two as of now. I really don't know what to think about this one, since as I said before, they posed no threat to the neighbor. But then again, residents of Texas have the right to do so if the they feel they have the legal duty to do so, as stated in the article.
So, what do you think about this one, fellow posters?

I thought you could shoot someone that was trespassing in your property and carrying a weapon at the same time.

one time i got robbed, and the guy had a knife, so if i caught him, he might of stabbed me. so i would have shot him

I'm inclined to lean on the side of the shooter, just from what I've read. His fate may highly be decided by the attitude of the homeowner.
The problem is: how far do you set the limits? What if you catch theives running out of a building while you're strolling down the street (with your gun... hmm).

The two weren't trespassing on the guys property, and they posed no real threat to the guy either.
The operator was even extremely calm and repeated to him that the police were on the way.

Yes I did say that what I meant to say by it was that they could have hidden it under their clothing and then hurt the guy's neighbor. IMO, I think the guy that shot the other guys shouldn't have killed them just shot them in their legs or somewhere else but not killed them.

Whether he was shooting to kill or not isn't made clear from the article. One guy was shot in the side though and died shortly after. I suppose at the range that the shooter was at it was possible to aim for the legs. I'd imagine that when you're in that sort of situation it's not really easy to make seemingly easy calculations.

What's pissing me off about this is the Black Panthers. Every time a black person is killed they always show up and say it was Racially fueled. They need to back the fuck off. Though the guy is guilty he doesn't need jail time, he was just protecting his neighbor's house.

"The Texas Penal Code says a person can use force or deadly force to defend someone else's property if he reasonably believes he has a legal duty to do so or the property owner had requested his protection."
The man knew that the homeowners were not home and he knew that the police would not get there in time. He told the burglars to stop and they didn't. I'd say that he could reasonably believe he has the right to protect his neighbor. How else is he going to stop them? An older man is not going to detain two 30 year old men with his hands. He had a gun, he told them to stop, they didn't. He's just going to let them make off with his neighbor's stuff and let the police handle it, even though they couldn't even identify the nationality of one of the burglars post-mortem? Fuck that.

So if he did not have a weapon but his fists. What will happen? Is there any right to kill him if you see him rob your property. And I read same kind of article about 3 teens killed a old man while robbing a apartment our something like that.

I think killing them was a bit harsh, he could have tried just shooting them in the legs or reasoning with them before pulling the trigger. :P

In my opinion, he did the right thing, I don't see how being a vigilante is wrong when you're actually helping people. Why the hell should he just let his neighbors house get robbed when he has a chance to stop them?

I was JUST about to post this, and you happened to be last post.
He should be given a medal and commended.
He TRIED to do the whole law-abiding thing, he called the police, but the police were not going to get there fast enough, they woud not have done anything. The people would have gotten away and they would have been free.
If more people were like him, the world would be a better place.

The police were on their way. With the proximity they had along with a vehicle description they would have most likely been apprehended. What he was doing was attempting to establish an allabi. And in doing so he shot himself in the foot, figurativly.

Did you listen to that call? he spent the entire call practically begging the officer to let him go shoot them. He was out for blood. Yes they were stealing things but he could have waited for the cops or held them at gunpoint. Breaking and entering is not an exicutable offence. The man was in no danger. He is a murderer
