well, you need permission from the makers- most commercial music needs permission- most people that do use stuff by popular artists (I'll used the example of red hot chilli peppers since im listening to them right now...) is actually against the law...
so, if you do put their music in your flash, they'll ask you to delete it... and then they could sue you if they wanted
all audio on this site you can use under a creative commons license (wiki)... that should be correct...
HOLY FUCKING SHIT! I FOUND THE LIST OF WI/HT SPAMMERS ITS HERE- if you are angry, PM me! (:

If you're using some music where the author hasn't waived his rights, it'll always be copyright infringement.

So if we sent an e-mail to the author of the song and they said "yes" it would be fine? Even if they're a big band?

If it's a big band, I believe that it won't really matter. Technically, it's copyright infringement, but it's not a big deal unless you distribute it commercially (Sell it).

If you are a student and you clam to be using the Flash for a class project you will be completely fine. It's apart of student rights. Also, you will be ok as long as you don't make any money from your creation.
