I read about this in a QI book i got at Christmas. There officially Cakes.
Cakes and biscuits are exempt from export tax in the UK but chocolate covered biscuits are not, so McVities had to prove it was a cake. It rested on what happenes when they go stale, a biscuit will go soft and soggy but a Cake (and Jaffa Cakes) will go hard.
Also, the orangey bit is made of apricots and not oranges.

They're cakes. The're net even like biscuits, except for the size. The taste and texture is just like compact cake.
