During the Korean War, an american soldier went AWOL. It turned out that he had defected and gone local. He married a korean woman, and had 3 kids. Now, for the first time in 40 years, he returns to US jurisdiction. If he is found guilty of treason by a court marshal, he will be sentenced to death. He is over 60 now. Should he die?

Over 60? Look, the Korean war has been over for decades. I admit, if this had been a recent defection, then we should put him on trial. But look at him now, he's a senior citizen. He's got kids for God's sakes.

So no. No prosecution.

The idea of prosecuting someone so long after their crime seems ridiculous to me...

If he is tried and sentenced, it shouldn't be all that harsh. If anything, strip him of citizenship and send him back to NK. After all, he has decided to live there for 50 years..let them have him.

Statute of limitations? Does the law have no bearing when the government is involved?

Your brilliance is astonishing. Yet, this thread has nothing to do with Jane Fonda. So take your little bitch responses elsewhere.

Humm.... the only good thing this flamewar has is that they are sorta staying on topic, not just resorting to back and forth flames.

Jane Fonda could be perfectly relevent in many ways to this, there is no need to immedeatly resort to flaming after one post. Try asking him why he mentioned Jane Fonda, and then, if his answer is stupid, flaming the hell out of him.

There's a system people, use it.

And back to the topic, this is a difficult situation, if we don't punish him in some way, it will send a message to soldiers that if you go AWOL and don't come back we won't do anything. However, we can't in good conscience punish a 60 year old man for doing something so long ago.

I say, light prison sentence.

So protesting is a death sentence?

Albiet she didn't know the difference to whom to bitch about-- the government or the soilders, since it was clearly not the soilders' fault for doing what their government told them to do.

is that what they teach you kids in school???

Korean war never ended, hostilities just ceased in the 1950s. Then guns are still pointed at eachother, and they all have live rounds in them. Every couple of months someone dies over there from stepping too far into the DMZ.

There is a reason Korea is called a hardship tour in the US Army. They work your balls off for a year and a half, and you always have the threat of getting randomly shot at.

Thank you Jim your probably the only smat guy here, and red skunk you can go play with yourself because 1. Argueing over the internet is running in the special Olimpics, even if your win your still retarded and 2. God forbid if this situation was reverse because I would have been banned in a heartbeat, but I don't care and as for Spanishfli, what you thought you could just defend Hanoi Jane and just walk away? HELL NO, I DIDNT SAY PROTESTING INDICATES YOUR A TRAITOR theres been hundreds of protest and by what you just said they all should be sentenced to death?

I think I need to school you and learn a lesson about Hanoi Jane, she did a great job destroying US troop morale and trying to convince South Vietnamese they were just a tool, and lets look at Treason: "Against the United States, shall consist only in levying war against them or in adhering to their enemies, giving them AID AND COMFORT...", and as for this Korean traitor will he be sentenced to anything? Probably not
p.s. you should read the book "Aid and comfort" it was a good book

I was under the impression this thread was about a Korean vet who went AWOL. Jane Fonda has nothing to do with this. Please figure it out.

Wait a minute. According to your simile, you're running in the Special Olympics as well, since you're arguing over the internet. Only you lost the argument. So by your definition, skunk may be a retard, but he's a winning retard. However, according to your simile, you're not only retarded, you're a loser as well.

Treason: "Against the United States, shall consist only in levying war against them or in adhering to their enemies, giving them AID AND COMFORT...", and as for this Korean traitor will he be sentenced to anything?

Am I missing something here, then? Unless he actually fought against the troops or aided them, shouldn't he be on trial for desertion, rather than treason?

Secondly, why isn't there a statue of limitations on such trials?

I think he is not returning to the US willingly-- he had some kind of liver disases, intestine disease, and he was discovered like that, and the US wants Japan (or was it Korea) to export him back, but he's staying there (at least as much as I remember) as long he has that disease to prevent him returning home.

Nobody isn't going to do anything to the old man who looks likes the epitome of grandfatherly goodness.

But after election time, it's the Texan Treatment for him ala BBQ style...

I think it is wrong to do such a thing. Put someone on trial for treason who has kids and become married. I mean, its not like he was fighting for the Koreans.

Love isn't treason. <333

String the fucker up by his balls. He leaves the Army to go make propaganda movies against America and I am supposed to feel for his old ass? No way. Leaving your buddies who depend on you and going AWOL is cowardly as hell, in wartime or no wartime. Prosecute him to the full extent of the law.

How do you know he made propaganda movies? Do you have a source for this?

No way. Leaving your buddies who depend on you and going AWOL is cowardly as hell, in wartime or no wartime. Prosecute him to the full extent of the law.

Then shouldn't he be tried for desertion, unless they can actually prove that he aided and comforted the enemy?
