Cyber-Bullying now a Tort

Cyber-bullying is a tort in Nova Scotia, it isn't a crime, but a tort, which is different; but the legislation that passed is only because of the Rehteah Parsons case, which is complete bullshit since it's clearly a limit on the Canadian Charter of Rights and Freedoms section 2b.

The way the legislation is wrote up allows to court to have a very broad interpretation, which is not justifiable under the charter and is clearly an unreasonable limit on the section I mentioned.

Don't get me wrong, Rehteah killing herself over being raped and publically humiliated the way she was is definitely a tragedy, but freedom of speech is not something I will compromise on over a teenager killing herself. To bring about legislation in such an ad hoc way due to public outcry is a farce, there are no reasons to set a limit on freedom of speech over this, and to think I could get sued now because I've offended someone on the internet now is completely fucking retarded. We have something in the criminal code for situations like this, it's called harassment, section 264, and everything that is laid out in that section covers it fully.

The fact that you can now sue for damages over "cyber bullying" is a laughing stock to me, and I feel like I should sue anyone and everyone that's ever sent me anything remotely vulgar over the internet to show the courts how ludicrous this is. "He told me to fuck off and now I want to sue him for damages because it made me feel bad" this is what the legislation has gave everyone the right to do in Nova Scotia, it's absurd. What's that, the person you're suing is a minor? Not a problem! It allows for you to get money from their parents! Yes! People that didn't do anything to you now have to give you money! Isn't it great?!

Here's the definition the Cyber Safety Act cites for cyber bullying " means any electronic communication through the use of technology including, without limiting the generality of the foregoing, computers, other electronic devices, social networks, text messaging, instant messaging, websites and electronic mail, typically repeated or with continuing effect, that is intended or ought reasonably be expected to cause fear, intimidation, humiliation, distress or other damage or harm to another person's health, emotional well-being, self-esteem or reputation, and includes assisting or encouraging such communication in any way"

Does anyone see my problem with this now? I'm going to leave a link at the end of my tirade for you all to check the legislation for yourselves, the part where it talks about powers of the court is extremely broad and gives the court a huge leniency in how they wish to punish people and interpret matters.

I agree, although this particular legislation was brought into effect because of pictures of an alleged rape were circulated around a few high schools in the girls area, and her suicide, that's important to the context as well.

Given that it was an alledged rape that was posted online, there is a high degree of sensibility that would go to something with that. That said, cyber-bullying is a joke and the fact that people are willing to prosocute people who do this are either clearly insane, or are really that dim. The Internet is chocked full of insulting behavior and websites that are full of angsty assholes, trolls and the lowest common denominator, and if people don't know that, then they shouldn't be on the Internet in the first place.

Except in the case of death threats, and a few other reasons, there is no logical reason why anyone would call the authorities over silly insults, much less get troubled by something that is in almost every chat room and forum post online in the first place.

Also, Cyber bullying is why kids should be exposed to heavy Doses of NG at a young age. I know its killed all my sensitivity towards being called names via text and people out right attacking me for no reason (just trolling as I know now). Now it only stings when someone who I care about says such things, damn good thing you're all worthless in my eyes.
