IâEUTMm working on a pokemon mmorpg with 16 other people. We are using Java. We have spots open for anyone that has a qualified skill such as graphics, programming or mapping & music that wants to help. We need more java programmers.

We are now picked up by an indie company. There is a chance of profits to make the game. Programmers are continuing in as3 so that the game can be available as a phone application & on PC.

If it's a non-commercial project then there's not really anything Nintendo could do.
However he mentioned profiting off of the final product, so I'm not really sure what his plan is.

The game is non profit. We won't make any money off intellectual property. Therefore Nintendo/Gamefreak can't open a lawsuit.
However, the head programmer of this project owns a server farm (He owns the Indie Company). We won't have to pay for use of the server. When the mmo gets people playing daily our group will be able to profit off of server activity. The more people that play the game, the more money everyone makes. Although, we will have a cap limit on our server so we don't have the same fate as Poke'net.

the easiest method is just sending me a Private message or email and give me your skype so that you can talk to the head programmers. That way there isn't confusion on forums and a more indepth conversation can take place.

They still could, and they would win, even if you were legally not in the wrong, simply because you wouldn't be able to afford to fight the lawsuit.
You may remember the project Chrono Ressurection which was a fan-made, non-profit, remake of Chrono Trigger. Square-Enix sent the creators a cease and desist and now the game will never be made (their reasoning was that the game could have a negative impact on sales for Chrono Trigger on the DS).
And then there are companies like Apple that will sue anyone for whatever reason they feel like because they're Apple and do whatever they feel like (there's a different message board that I am active on that was threatened by Apple because there was a thread that hotlinked to an insider document regarding a Macbook; the message board did not host anything; it only linked to it).
Nintendo isn't known for being sue-happy, but it's still something to think about. At the very least I'd say that you should speak to a lawyer whom specialises in copyright and trademark laws.

I graduated with a degree in accounting. I'm aware of the angles that can be taken to avoid litigation. My senior project was based on Apple & Microsoft lawsuits. Paying for a lawyer would cost a fortune just to describe the project. On the other hand I've spoke to majority of the developers and owners of the other pokemon mmo's and know that a game can be made to resemble pokemon and not face any issues.
Different regions, custom items & gear etc.
A bunch of things can be done with a creative mind.

We are actually not going with a pokemon mmorpg anymore. The goal of our project will still be based on monsters battling. Although, we will come up with a completely new storyline, different capturing methods, creative monsters, new forms of evolutions / fuzing etc.

Let me rephrase everything and start over.
We are taking our as3 engine from the planned pokemon game and using that for the monster game instead. We aren't making a pokemon game. This way when the game is made it can be put on Windows, Linux etc. and Smartphones. We no longer need Java Programmers. Although, if someone understands the syntax for as3 they can apply to help.
Graphics are planned to be 2.5D and possibly battles might be isometric. Either or can be coded in as3.
We currently have a 10 page blueprint that we have written for the storyline which is under constant edits and improvements.

For anyone actually reading this thread at a later date, the quoted statements are 100% incorrect and will get you sued. I don't know where they got the idea that this is how it works, but it doesn't. It never has.

Postulating an opposing view without providing any explanation or evidence does not make a compelling argument.
Either way I made it quite clear in one of my posts that there is a very real possibility of legal action being taken against the OP.
