A Copyright Question. 2011-08-14 09:18:17 Reply

Alright, so a friend and I will be doing a collab on a Flash at some point.
He basically said "Oh, I found this song on YouTube, it fits really well, it's great", and the song really is great. It fits everything. The only thing is, it's (obviously) not royalty free, but the song is by an indie record company (Merge Records, and more specifically, a Mountain Goats song).
After I told him about copyright, he said he wanted to just use it anyway, but I'm not really sure.
I don't really want to use it because it's supposedly illegal, and I'm afraid that the record company would some how fine one of us up the ass.

But to my friend, if the song isn't in the Flash, and if there's not a replacement, the quality of the story and the Flash in general would be dumbed down a bit.

Any suggestions?

As long as your not making money off the song or claim the song is yours I think your good to go just in case just say in the credits that you do not own the song. But if your still not convinced go to the Audio Portal for many songs that you can use.

Just ask if it's cool to use their song. Even if you do make money, sometimes they're cool about it. Just be like I'll credit you and stuff. Good Luck.

Well newgrounds profits off of every animation here. So even if you don't make money with their song, newgrounds will, and that could be considered fraud in the greater scheme of things. Stay safe and ask them for permission. If they say no then use a song on the audio portal. There's almost half a million submissions there, and a few of them are bound to be good.

You can't know what you don't know if you can only use yourself as a reference point.

Read this

If you really want to use the song, you can go out of your way to email the company and politely ask them if you could use their song in your animation
