US based sites have a history of being shut down for copyright laws, especially when they garner a lot of attention.

4chan is far from a normal scenario. You might as well have suggested the PirateBay as an example.

These lawyers aren't just giving threats, it would be easy for them to ruin this site. Just GOING to court could bankrupt NG, even if we won the case.

Civil suits about offensive material are far different than legal suits coming from copyright holders. They're not even in the same ballpark. Try calling a lawyer about getting punitive damages for an offensive internet video and he probably won't help you.

But hey, if you're so confident, then start a torrent/video site and base it in the US. Heck, use a CA hosting site. Don't put any ads on the site, so it's covered by 'fair use'. Refuse to take down any of your content. Those guys are absolutely powerless and have never shut down a site before, you have now worries.

The means of which this post was made is in poor taste though... Tom shouldn't be telling anyone to DO or NOT DO anything... He is no god, nor an authoritative figure in your life... He is a man who owns a website/company, nothing more...

I hope developers of original content are stirred to start their own websites for their own individual content. Starting teams and companies aside from this place as they move on from the orange city! If working together is the key to Tom's statement then work together but do it in a smart fashion with the goal to benefit -your- team not Newgrounds! Why give Newgrounds the traffic/money when it can be your own!

And finally:

If you want to make a flash music video of your favorite song -DO IT-. Do what you want and be happy! Just don't post it here as they surely don't want your work. Share it with as many people as you want, its your gift!

I'll offer my help if anyone's looking for particular songs in the Audio Portal. I know about loads of songs in the Audio Portal (heck, 80%+ of my music folder consists of Audio Portal songs).

I'm all for using Newgrounds' content, and although I know there are indeed websites that offer royalty-free sound effects (often they are kinda sub-par, but that's beside the point), perhaps it'd be great if Newgrounds users uploaded sound effects of their own, and could compile them in one place? Not necessarily a new portal, but somewhere flash artists could find them. I don't even know how many people are into making sound effects, but that could be a great resource for flash-ers.

I do actually believe the idea of everyone working together is a great idea, and so is not using copyrighted material... the problem is that only the latter aspect I believe can actually be made a reality. The problem the worries is, generally speaking, is that - especially in regards to art assets - people will tell others they are not worthy of their help if the person asking is not already established. People seem perfectly willing to help someone if they already have a name for themself, but these terms seem like they will serve to increase the difficulty of getting there. I fear this movement will create an access to resources having elite, because far too often you need stuff you can't just find randomly laying around. The only help non already made people will be able to find will be from people whose work isn't good, because they were unwanted by established elite who had no need of their crap, and thus the work made from it won't be able to establish anyone to a level where they can actually get access to good help.

Do not be confused, I do think it's a good idea people stop using copyrighted images and the like. I just think the alternative suggestion that you get the community to work with you to produce what you need will only work for the already most godly people here. Everyone else will be left out in the cold with no resources legal or illegal from this point on, or at least no resources of a quality such that anyone will ever care about their product.

You can enforce a ban on illegal material usage, and you most certainly should, but how the hell do you intend to enforce a truly communist sharing of help with no status tiers forming within it?

I don't see how this was me trying to be God. The people who post content on Newgrounds CAN get sued and charged licensing fees, this post was the result of some recent issues and I wanted to give people a stern warning. They can go ahead and start their own websites and get sued there, too. Your post seemed like it was trying to hurt NG more than help anyone.

I assure you, I ride no cock. I speak for the artists, not for corporations as I have very little business sense.

Building on the work of others is one thing, but using someone's stuff without permission is the issue here. You can't force anyone to share. You can protect your own work from piracy or choose to share it, that's your choice as an artist. Which is good because where is the incentive to create anything if your ideas aren't yours the instant you create them?

When the world abides by the "everything is mine" mentality true ownership goes out the window and with it the artists' desire to create. It's everyone's right to protect their property, intellectual or otherwise.

I've never really understood why someone WOULDN'T want to make something with entirely original content, I mean I get that sometimes people are inspired by or get ideas from things that they see/hear elsewhere, but wouldn't you still be able to take more pride in something knowing that you and/or people you worked directly with created all of the content together?

Theres a fine line between sharing ideas and taking the products of those ideas without permission. Yeah corporations use copyright law to take advantage of artist, that's no secret. Copyright law also helps protect the little guys from large companies as well.

It's not like we need to use copyrighted materials to express ourselves. If anything, using original works and releasing them under creative commons is the first step towards free media.

Although, now I realize how much of a potential bother I was. My apologies.

I will be more mindful of this in the future. I have to admit, though, this puts a damper on some bits of current and future projects. I'll see what I can do to remedy them.

I think disallowing copyrighted music is an awesome idea.
