This 13 year old was being bullied by a child much older and larger than him. This had been going on for a while and the kid was a known bully. He decided to pick on this smaller kid and try to beat him up once again at the baseball park.
The smaller child was scared to death after the larger kid pushed him down and yelled racial slurs at him. He didn't want to be beaten up again. To defend himself he hit the other kid in the knees with a bat not using his full strength. He warned the kid to leave him alone and to stop trying to hurt him. The much larger 15 year old decided to attack him once again. The kid hit him in the face with the bat to make the other kid back off. It was pure self defense.
The kid who got hit with the bat died.
Now the younger kid is stuck in jail for 12 years and that just pisses me off. The kid beat him and others up time and time again and the kid just wanted him to back off. I can guarantee he didn't want to kill him and it was just an accident. He just didn't want to be beaten up and the bat was the only way he could make the other kid stop. He should not be in jail. He should be in counseling helping him cope with the fact that he accidentally killed another kid.

That kinda sucks but it's not really that hard to kill someone, I mean, if my dad would get his uber rage shoes on.. dear lord..

But it wasn't like he meant to. He was only doing it so he wouldn't get the shit beaten out of him. It is stupid to be punished, just like how some states won't let you shoot someone when they break into your house and try to rob/kill you.

So if someone enters your house with out noticing and he threatens you. You have a bat in your hand, hit him with a warning hit, he still continuous and you hit him in the face. He dies, your safe. Clearly its self defense and the kid's punishment is to much.

but yeah. I don't think that kid should be in trouble. What was a 15 year old doing bullying a 13 year old kid? What was he supposed to do? He couldn't just sit there and let that guy kick his ass. This is pure self defense.
I can empathize with the situation, but he probably could have hit him in another area than the face/head.

That kid should not go to jail if that story is true.
The article made it sound like the bully was the victim, though. It was totally against the accused.

He didn't mean to kill him. The kid cried when he noticed the other kid was dead. He just didn't want to be hurt anymore. I feel so sorry for him.

Yeah i see your point... but the bully didnt enter the kid's house.. He could have told someone he was being bullied. Or just ignored him. He didnt have to crack him in the face with a bat.

I doubt that if you are being bullied the bully would not let you run and tell someone without having beaten up first.

The kid will still be bullied if he tells an adult. He will be called a snitch and what not, and there will be more bullying. The kid didn't meant to kill him, but a self defense. He used final offer which was violence. He even gave him a warning before he hit him.

I don't think you understand; the 13 year old didn't have to reply with violence as well. He could've reported the other guy to the police and there- the problem solved. Meanwhile, why would the kid be out with the fifteen year old? I'd probably stay inside and tell my parents.

Maybe the sentence was a little too much, but he still killed someone, even though it was involuntary, so he should still have to attend some form of counseling or something similar.

Eh... Well you can't blame him for that... Maybe that punishment was too much... But I still don't think he should of just gotten out of trouble without a punishment...

As I understand it, self-defense would definitely matter if the 13-year-old was at risk of getting killed or being seriously injured at the time it was happening. He hit him later and we don't even know what else the bully did, if anything, other than push him and use a racial slur. I can see how the 13-year-old got charged with manslaughter. If that bully was threatening to kill him or something, he could've told his parents or the police, instead. I do kinda sympathize with him and I have to wonder if he's been paroled by now.

Even if what you remember about the Dr. Phil episode is true; that this had been going on for awhile and the bully tried to attack him after the hit to the knees, that's still iffy. Did the 13-year-old swing hard? If so, there's no reason to do that if it wasn't life threatening or the like. I don't know the law in Los Angeles, though. Maybe as Dew mentioned, it was laziness on the judge's behalf.
