Can Police outrank the Military? 2009-06-12 19:03:12


This is a question that has been bothering me for years. Since they both work for the executive branch, would say, a police Captain have more authority than a military Lieutenant?

Meaning if both were somehow put on the same duty, would the lower ranked individual have to obey his higher ranked superior regardless of service?

I'd think it would be a matter of jurisdiction.

Then again if it's big enough for the military to be involved, I doubt the cops would be gung-ho to stay and argue.

Yeah the they are, police handle matter back home while military tend to handle international disputes. But since they work for the same governmental branch I have always wondered if a high ranked Police officer is superior to a low ranked Military officer.

No, Police Departments are not part of the DoD.

A Private in the Army could go tell the Chief of Police to go screw himself and get away with no punishment.

The Police do a respectable service, but when it comes to an actually emergency (war on home territory), they wouldn't do anything other than attempt to maintain the lives of civilians by providing civil services.

I, personally, know that I would never listen to a Police Captain as a Lieutenant in the Military.

Despite training to be an Police Officer myself, as a civilian I would listen to a soldier over an officer myself, it was just a question thats been bugging me for years and I never got a straight answer.

A FEDERAL military unit would outrank a STATE officer... They both work for the executive branch but at different levels.

They do different things. The military isn't allowed to carry out police actions, while police need to operate within their nation's borders.

Simple answer:

If the military has no jurisdiction, they cannot do a thing, and the police have full authority to tell the military to not get involved.

If the military has jurisdiction, or is granted temporary jurisdiction, the police all answer to ALL military personnel.

A higher ranked Officer could be put in charge, he could put the Private in charge of a Major. Even though its uncommon it does happen.

I guess the same thing would happen for Military/Police interactions.

Jurisdiction determines who orders who around.

Military is federal so largely would be put in control if there was a situation where they need to work together. It's feasible though that there could be some form of situation where federal assistance is being provided but jurisdiction is given to the police based on their personal experience in the situation. Though such incidents would be few and far between I would imagine.
