And yeah, the prison IS as fault. Prisoners fight? Well tough shit, JAIL THEM. How about that? If you're going to let them fight anyway, why don't you televise it? Organize prison combats like Gladiator, no sense wasting this delicious violence. You'd make back your 4 million.

This in a way also effects the rights of those who may be innocent or on trial, especially over allegations such as this that could be false. I suspected he plead guilty to a lesser charge because he didn't know better and the lawyers took advantage of his ignorance. And kids today know everything down to the nasty bits such as this. Why a lesser charge?

There is a protocol to these sort of things that all prisons follow. That I know because I've actually talked to prison guards a few times in my life. And it's something that I could easily imagine. After all-- prisons want peaceful passive inmates. Not inmates who want to cause trouble with other inmates and therefore create a sequence of reactions that could possibly lead to total loss of control. I'm sure prisons want everything smooth as possible.

Prisons don't need to protect all inmates-- just the ones who are at high risks of being brutalized beyond the normal circumstance of the situation such as transgendered prisoners, child molesters, and the physically disabled. It doesn't matter if he's illegal or legal-- EVERYONE has human rights. We're bound by physical law, but there's something higher than that... the sense of decency for our own selves. I respect myself enough to go above the sense of "Let's-kill-this-mother-fuckers!"

But our prison systems should be about locking up criminals and taking away their freedom-- not suffering them. We already know what scandal Abu Ghraib created.

If the prison is failing to do its job, he has a basis to sue.
And his case is about showing if the prison either failed to protect him, or actually aided his brutality (which is basically the plot line in Miguel Pinero's "Short Eyes".... go watch it if you have a chance, it's great.)

That's why they're usually kept in a separate block, rather than dealt with on a case-by-case basis. It's not hideously more expensive, and since they're all in the same boat, they won't be singled out by other inmates.

Honestly, in my opinion, any person who has such a lack of morals that they can commit any sexual crime, such as rape, is no more than a parasite whom deserves and is asking to be executed. This man is a child molester. If I ever came across this, the man would be beat within an inch of his life and given to the authorities. Things like this cannot be tolerated, and this disease afflicting humanity has to be cured. And if i was a part of the kids family, forget it. That scum would be found in a riverbed 15 miles away.

The rule of law must remain intact in all sectors of life including prisons, regardless of whether or not the crime a person commits is heinous. Emotionalist arguments interfering with objectivity is what causes chaos and instability.

While it may seem counterproductive to award damages to a person who has committed such a crime as child molestation, it is well within the realm of freedom and equal protection by the laws that a person who has been subject to forms of torture, regardless of whether it was warranted in the spirit of reciprocity, is indeed entitled to compensations.

To simply write off the ability of this person, however despicable they might be, to collect such compensations for brutality that was caused by an error of the state (placing the man in a normal prison population), is to deny freedom itself, and that is a slippery slope.

I do think people have rights when under custody, but I don't think such a lawsuit should be filed by a child molester. I know It's law, but sometimes people choose morals over whats inevitable. If he's getting beat, put him in a more secure prison.

Child molesters should be treated as rapists. They scarred a child for life, and should have to live with it, knowing what they did. No electric chair (sorry Texas), no lethal injection (sorry meth-addicts), okay? Those are easy ways out of the pain he will feel knowing that he has scarred a child and that the child will be forced to remember that forever. Kids will taunt him, and he could be (depending on the kid) fucked up and go insane.......all because you buttfucked him.

That's the states responsibility. They should have put him into protective custody. On the other hand, 4 million dollars is a bit high. He should have his medical bills payed for, but I don't think he should get spending money. Child molestation is a sick thing. There are consequences.

He was already being punished by being in jail, and any other inmate who gets as assaulted as he did in jail would get compensation, and a lot of them did probably committed worse crimes than he did.

There's rehabilitation, food, general living expense such as rent, and just about everything that costs money until he's dead (and that in itself costs money too.)

Average life expectancy for a Mexican man living in Mexico is 73 years old.
So he has about 50 years more or less of life to live (that's assuming if he lives that long.)

There's a lot of stuff going to happen from here to then on... more than likely, he's going to have to pay for many care providers for the rest of his life. And that's costly as heck, especially in Mexico. When my grandmother needed to be cared for, it was easily 1,000 to 2,000 american bucks per month.

And then that will also be taxed too.

He's not going to live in the lap of luxury, especially if he's not going to be making that money grow. It's going to sit there and take care the expenses for the rest of his life.

But, of course, it depends if the prison failed to do its duty...

We don't have the money to pay for a separate section of the jail for sex criminals? Wouldn't the only additional cost of that be hiring some guy to move around some cell assignments so that one specific block happened to only have pervs in it?

What about the wife & kid eaters that are serving life already? If they beat up a guard or an inmate, they just get years added onto their life sentence.

While I kinda see this as a case of bad karma biting the inmate in the ass, it still doesn't excuse the guards for allowing him to come to such grievous injury. Imagine if the inmate had actually died.

If you mollest children, you deserve to have your head kicked in by cranky inmates. That said, the prison is responsible by law to make the enviroment as safe and healthy as possible. If the prison did not uphold that obligation then they are liable. knowingly endangering the life of an inmate is defined as cruel and unusual or at least negligent depending on what actually occured. For instance throwing him in a cell with other inmates knowing he would be beaten as punishment for an infringement is cruel and unusual, while not stopping a known threat or not ending an attack is negligent. That's just the way our laws are and there is a good reason for that. So while I think he doesn't desrve a thing and would likely been better off for everyone if he'd been killed, I also think the prison is liable for not living up to it's responsibility. child molesters are still humans and need to be treated as well as any other human. Even if I do hate them.
