If an attacker says he has a knife/gun/etc. and will kill the victim if she makes a sound (happens all the time), most victims will be quiet. You know, not wanting to be killed and all. It's also the reason you often don't see a struggle (not wanting to be killed). Also, you have to understand that rape victims feel a huge amount of shame. People who work with rape victims understand why most will not draw attention to themselves when it's happening (having it happen is shameful enough in their eyes, but calling over so many witnesses?). This is exactly why women will often put up quite a struggle before the actual rape, but become quiet and passive during.

And call me biased, but if I see an ancient transient on top of a young girl, it's going to raise a red flag for me.

So for all of you people (men, I see) smugly questioning why someone wouldn't scream and draw people over while it's happening, there's a little insight for you.

How about this true story:

When I was living with a friend one day she got some guys over to get some drugs, they went into the toilet and shortly after me and my other freind heard a little banging. We didn't think much of except that it was weird that it suddenly stopped after literally a few seconds then started again but it was softer. We whispered to each other about it and decided if she was getting raped she would say something.

Turns out she did get raped and had a knife pointed at her face and stayed quiet claiming it was because she didn't want us to get hurt. She also said he just wanked on her but we heard what happened and without anything to go on except she was a slut and it started rough and maybe she told him to soften it up a little we didn't do anything to stop it. That's also the only time she lied about sex to us so yeah, I buy it.

I think a lot of the posters here are hypocrites, because the bystander effect is probably very strong.

But to a certain extent, of course.

That's uh...a little spooky. Surely, at LEAST one person had his or her cell phone so they could call the cops.

Well, I'd like to think I would've at least called the cops, but you don't know how you'd react in that situation until you're actually in it.

I'm pretty sure most of it is the bystander effect, but you've got to consider other factors as well. First, would you instantly know what to do in a situation like that? If it was happening right out in public with a hundred other witnesses, wouldn't you just assume it's a misunderstanding on your part? When you see some shocking or horrifying, your brain doesn't want to believe it. You feel a deep fear creep through your very soul, and your first thought is to distance yourself from it, not fix the problem. Instead, your mind turns to what you are doing right now, and comes up with a million excuses to let someone else handle the problem.

Another thing, America is a really fucked up nation. Our justice system is pretty much gay.

Let's say you were a part of that crowd. You don't have any training or any sort of education on what to do in a situation like this. You see that and common sense goes out the door. The world stops for an eternal second, and the only two things that go through your head are "I'm gonna kill that motherfucker" or "Just keep walking...." You realize that calling the cops takes time, and you won't take the time to consider it. With the cops in mind, you know very well that kicking his ass will result in a lawsuit and/or jail time. That leaves the option of walking, which you are most likely to choose--ESPECIALLY when paired with the bystander effect.

It's sad, but true. If you don't have a good lawyer, you are fucked if you try to help. Either that or you better hope his lawyer is total crap.

Honestly, I think the witnesses' lack of reaction is being blown out of proportion. For one thing, I didn't see anything in that twittered "article" that said a crowd gathered and just watched, yet that's how posters are treating it. People were probably walking by, 2 or three at a time, and saw skin out of the corner of their eye and barely looked. They were behind bushes, after all. And were there really hundreds of witnesses, or hundreds in the park itself? That could easily be misrepresented...

Now, it's been said here that many rape victims wouldn't scream, but how many of those passers-by know that? For that matter, if you walked by and saw that little scene, and there wasn't any sign of struggle, what would you think? She may have been threatened, but how would others know that? They probably just thought it was some couple having kinky sex in the park.

That being said, it's horrible what happened to this woman. The lack of help is tragic, but it doesn't mean we're a cold, uncaring society. We're just stupid, uninformed, and indecisive.

I wonder if any one of those bystanders went home and told their friends saying "And no one even helped her!"
