Yeah, its the restaurant's fault that you have bad credit, and sueing them is totally going to change your credit.

Sue the credit card company then sue the people who stole your money then sue your money.

For my next trick, I will need a condom and a volunteer.

Definetely sue for negligence or something similar. Don't sue the individual person though, try suing the restaurant. :3
