Sounds to me like that's a good basis for a case. Considering the damage they caused you, I say go ahead with it.

I'd sue like a motherfucker. Just because i've got a perfect credit rating and I would do the same thing if that happened to me.

Maybe you don't understand this: He has to pay 2,000$ a year because of this, and his credit rating is fucking screwed. You're quite stupid aren't you?
So? why should the an entire company suffer because of one small mistake, why should people lose their jobs because they mixed two small pieces of plastic up? you carry your entire life savings around on one temperamental object of course you're going to risk shit like this.

I'd be more inclined to criticize the banks policy on credit card theft. Of course it was'nt the victims fault and he should'nt suffer as such, but the real criminals have been brought to justice and thats something to be thankful for.

Why should people have to suffer from stupid mistakes such as these? They brought this on themselves and they should learn to look at what there doing before doing so.
Maybe with this lawsuit it will teach them a lesson and prevent less people from suffering in the process. Them losing there jobs would be there fault and theres alone.

2nd of all, are they even doing anything to retrieve your credit card? Because if there not then they deserve to get sued.

Sue them! And re. credit ratings, you can go through a bunch of hoops for them to remove it from your record if you can prove it was genuine credit card theft.

In addition, I would contact consumerist.com and tell them the story!

I don't think the waitress has any money

It is easy to prove that it is genuine credit card theft. The police arrested the guy who bought the TV with my card so I could use the Freedom of Information act to get my hands on a copy of the police report. That would be proof that this is real theft and I might be able to get my credit rating back to normal.

In addition, I would contact consumerist.com and tell them the story!

Nah, I don't like bitching to random websites about my problems

Oh wait...

*they're
*their
*their
*theirs

They're is a conjunction of 'they' and 'are', so use it whenever you would say "They are"
Their is a possessive. It implies ownership, such as "It is their responsibility"
There refers to being in, at, or towards a place, such as "There it is!". It can also mean 'in that matter', such as "I agree with you there!"

Should I sue?

There's no reason not to sue. So yeah, do it. Applebees wouldn't even try to defend themselves.

Yes you should talk to a lawyer about it and if you can, make Applebee's buy you the damn TV that was charged to your credit card on top of damages.

ARE YOU MAN ENOUGH FOR THIS?

Yeah. It wasn't your fault, and not only did you lose time in getting all the legal shit sorted, but also as you said they've fucked your credit rating.

Newgrounds is a bad place to go to for legal advice....
find a lawyer and talk to him. If he thinks you have a good case then I recommend you do it.

No seriously fuck you! Shit happens, get over and stop trying to blame and profit over every little thing that happens to you you pathetic shit, is it really so hard to get yourself a new credit card?

It's not he just lost his card if it's true, he has to pay an extra $2,000 a year because someone else's stupidity. To be honest maybe the person should lose their job for that. You wouldn't be pissed off if this happened to you?

You have a good case, all the facts are against the restaurant.
Just get a good lawyer (Please, don't defend your damn self) and you could well sue the restaurant for it's monehz.

LOL

Dude, you keep a 10k credit in your wallet? WoW.

That's a very dumb choice, my parents have 200k+ in their checking accounts. In their wallets they only carry one checking account card that never exceeds 1k, they always transfer money from the other checking accounts into the one they have in their wallet. Try to manage your credit this way.

ANYWAY, it was not your fault they lost your card, get an attorney and try to get back what was taken from you.
