Yeah, sue them. And make sure you get them for pain and suffering (from the stress and worry they put on you). They gave your card to the wrong person, and they charged a bunch of money on it. Why wouldn't you sue?

Get every penny you can out of them. That's what they get for having lousy service and bad food. But, yeah, you might want to go over this with a lawyer.

Contact the restaurant with what happened, blah blah blah, say you will sue. Sometimes a big company wouldn't want to get a bad reputation so they will could just pay you a lump sum of cash, or you could just attempt to sue anyway.

i was referring to the credit card company. but, i guarantee that applebee's has a team of lawyers on retainer. this is the common practice of big business, as they do a lot of contractual work.

It sounds like you have the decent case for it. Personally, I wouldn't recommend going overboard with what you ask for. Since you know the set amount you'll be paying extra, I would try to get only a set amount for that or even work something out where they send you 2000 dollars every year. I'm all for righting a wrong, but I hope you don't be like most other people who would just try to get way more than they need. Good luck with that.

Defiantly! Charge them to pay those $2000 for you! It's not your fault, it's theirs! That, or sue the restaurant AND the other guy for not realizing that it was your card. But someone needs to get dropped here. GET YOUR FUCKING MONEY BACK!

Sounds like you definitely need to sue.
And to the mranarchy dude, you need to realize how seriously fucked up this is. If a business gave you the wrong card, and someone spent a whole shit of money on your card causing your credit score to drop, you would't care if the company's reputation was ruined, you would want to sue them for ruining your life. There are mistakes employees make, but this is one of the fucked up ones in which they need to have their asses beat.

Definitely, this would be a good case. $2000 is a lot of money, especially each year. Think about your age, and multiply it by the number of years you thing you have to live.

If that number doesn't piss you off, think about the guys that took your credit card. They were ready to go on a million dollar shopping spree before you stepped in, the scumbags.

I would sue the restaurant, this is mainly their fault for not being careful with customer property.

I'd say you should sue them 100%. They messed up your perfect record, causing you to pay much more per year, and it wasn't even your fault. If that isn't worthy of a lawyer then I don't know what is.

o, if you're really really that worried about your credit rating instead of ENACTING SWEET REVENGE on the person who mixed up your cards, you should have your lawyer look over your credit policies and see what he can do, because, shit, if you've got a frickin' lawyer in your family's pocket, I'm pretty sure you're not stupid enough to sign up for a card that offers absolutely zero theft protection. And it sounds like that's what you're getting. I'd look into that.

Also, how long did you wait to cancel your card after you found out? Because where the FUCK do you find a $10,000 dollar stock television, let alone one where you can walk in, buy one, and leave, all between the amount of time it took for you to pick up your phone and cancel your card.

I canceled it once I found out that the restaurant couldn't contact the person that took the card. I was on hold with the credit card company for a half hour. They bought an HD LCD screen that was something like 60 inches.
