Should I sue?

Okay, here is what happened. I was eating with some friends at an Applebees. When we were done I gave my credit card to the waitress so that they could charge my meal to it. The waitress came back later to give me back my card so we could leave. They handed me the wrong card. I gave them back the card and told them to give me mine. The waitress came back but this time with the manager. The manager apologized to me and said that they already gave my card to someone at another table. That person already left.
They called the phone number connected to the wrong card they gave me, but they didn't get a response. I cancelled my credit card but the people already charged $10,000 for a new TV on it. I called the company to ask them to remove the card, and eventually the police found and arrested the people and the charge was dropped. Now, normally this wouldn't be a big deal, but I had an absolutely perfect credit rating. That credit rating dropped in half. This means that I have to pay an extra $2000 in bills every year because the restaurant lost my card.
Now, should I sue the restaurant?

Seconded. If it's not your fault that they lost the card, then it's hardly fair that you're now paying an extra $2000 a year. I'd say sue them and get your money back.

2000$ more per year? If it wasn't your fault, that fine should be revoked: Sue the restaurant, and find a way to have that credit rating fixed.

It was their mistake and it makes me sick that there are people like you who have this 'they done wrong I should sue them' attitude, you could lose someone their job and take up time and money from the company, not to mention wasting legal resources over something as trivial as this, theres real injustice and crime going down in the world but courts are taken up with 'she lost my credit caaaarrrrrd' bullshit.

No, but my dad ranks fairly high in his company and he can use the company's lawyer at a discount.

He states later he had a perfect credit rating and you don't even know what kind of credit card it is. There's no reason to distrust him but if you think he's lying then that's irrelevant compared to the people who believe him.

So? why should the an entire company suffer because of one small mistake, why should people lose their jobs because they mixed two small pieces of plastic up? you carry your entire life savings around on one temperamental object of course you're going to risk shit like this.
I'd be more inclined to criticize the banks policy on credit card theft. Of course it was'nt the victims fault and he should'nt suffer as such, but the real criminals have been brought to justice and thats something to be thankful for.

The company earns hundreds of millions of dollars a year. If I sue them it would probably be just for a dozen thousand or so. It's not going to hurt the company that much. Things like this usually get settled out of court anyway.

the thing is, at least in my experience, organizations like this(banks, insurance companies, the like) are incredibly obstinate and try to wait out claims to money/policy change. the best way to get their attention is through legal means. just lawyering up and talking to their lawyers could get your credit score changed or compensation. but, for a clearer picture you really ought to talk to someone in the know.

Yeah, sue them. And make sure you get them for pain and suffering (from the stress and worry they put on you). They gave your card to the wrong person, and they charged a bunch of money on it. Why wouldn't you sue?
Get every penny you can out of them. That's what they get for having lousy service and bad food. But, yeah, you might want to go over this with a lawyer.

It usually costs even more for a company to hire a lawyer on their behalf than it is to just pay the guy in a case like this. If I decide to call a lawyer I am almost certain that it will be settled out of court.
