Microsoft actually put a stop to that a while ago. People were gamesaving and selling accounts or competing for top spots on the leaderboards, people like StripClubDJ (who I actually talked to and helped with "Stuntman: Ignition" legitimately before the whole fiasco) were banned and had their gamerscore wiped out entirely. In his specific situation, he had a whole lot of gamerscore already because he had both a japanese and american 360 and imported a lot of games but he supplemented that with a lot of gamesaving as well and that's what got him wiped.
They have many systems in place now to catch that sort of thing early, and game saves have since tied to accounts/names to prevent it at the most basic levels. The best way to tell if anybody's legitimately playing or not on your own is to check achievement timestamps on xbox.com. If it just says "unlocked" with no date they did it offline and, obviously, if it's an online-only achievement, they're a dirty gamesaving prick.
