If Audio you're using is less than 30 seconds long it goes under the fair use act and is not copyrighted.
So if you the audio you use is less than 30 seconds you can tell youtube and threaten to sue.

1. This is some pretty good technology, to detect this automatically.
2. YouTube has a deal with most of the music companies to allow you to use copyrighted songs. Unfortunately, it looks like some are not covered, and if this becomes widespread, I really think YouTube is going to kill itself.
