ST. PETERSBURG, Fla. -- An attorney says he plans legal action against St. Petersburg police officers who handcuffed an unruly 5-year-old girl after she acted up in her kindergarten class.

A video camera, which was rolling March 14 as part of a classroom self-improvement exercise, captured images of the girl tearing papers off a bulletin board, climbing on a table and punching an assistant principal before police were called to Fairmount Park Elementary.
Then it shows the child appearing to calm down before three officers approach, pin her arms behind her back and put on handcuffs as she screamed, "No!"
Largo lawyer John Trevena, who provided the tape to the media this week after obtaining it from police, says the officers went too far.
"The image itself will be seared into people's minds when you have three police officers bending a child over a table and forcibly handcuffing her," said Trevena, who represents the girl's mother, Inga Akins. "It's incomprehensible ... There was no need for that."
Police declined to comment, citing an official complaint by Akins that has sparked an investigation by the supervisor of the four officers who were present. Two are new officers who were being trained that day.
Spokesman Bill Proffitt said the investigation would be complete in about two weeks and the findings would be made public.
The 30-minute tape shows assistant principal Nicole Dibenedetto trying repeatedly to calm down the girl, who ignores her commands and begins punching her. The child's mother was called but wasn't able to immediately come to the school.
After being placed in the back of a police cruiser, police released the girl to her mother after prosecutors informed them they wouldn't bring charges against a 5-year-old.

your relegions reflects who you are, and who has the right to tell you who or what you are? and if people don't like that it's their problem, thats persanally my opinion on the matter, many muslims were kiked out of school because they refused to take of their turbans down, and every body has differeces, thats what makes the world more interesing

well in fact not many people were expelled , really, not a lot at all,

and remember it's only in public buildings,generally schools, i've seen lots of girls go to school and take there turban off
your religion reflects the way you are but you don't need to exibit,it's not because you wear a turban that you're muslims,religion is much deeper than that
don't you think that from time to time we need to put our differences away to live in society?
finaly one of the most famous cases didn't involve muslims but catholic nuns who were asked to wear normal clothes when entering a school,so again this does not favorise anybody

Anywho, let me use the greater harm theory to explain this situation in those terms.

But first, I'll explain what it actually is. The idea is that if the harm to society because of a specific person's freedom is greater than the harm to the individual if that right was limited, it is considered reasonable to limit that person's right.

Now, in this case, the question is a matter of a person not being able to wear a religious symbol, or a person being allowed to wear that symbol, but having to get into a fight with another person over wearing that symbol, but the person defending themselves (I'll use Sikhs again, because it was a popular example with a number of incidents) may be wearing a knife as a religious symbol. This is bad, because if a person is defending themselves against an attack caused by religious hatred, and they have a knife, someone is likely to end up cut or stabbed.

On the other hand, this was a blanket decision that covered ALL religious symbols, nto just ones that incited violence, and it also covers people who wore those symbols but weren't involved in any sort of violence having to deal with it.

In other words, they limited a right of expression to pretty much everyone in the school system, in order to prevent a few fights.

Of course, what really happened was the government doing damage control because a few of these stories got leaked to the media, and they blew it into a big "WHY IS THE GOVERNMENT ALLOWING THIS IN OUR SCHOOLS??///???" fiasco.

So, to sum up, the situation is this:
The government is limiting the freedom of all students by not allowing them to wear religious symbols, in order to prevent a handful of hatred-feuled fights.

I'll let you decide which is the greater harm.

first the one who complained about the law were muslims, we heard almost nothing from them

and it' not cause of violence (listen i'm french, i'm in school i should know) it's just a beleif that when in sociaty we need to put our differences away,we're all the same students,here to work, your religion is your private life and should remain private
and again you can still wear religious icons just don't exibit it (put your cross inside your shirt for example(which was already a common practice before the law))
