If two people of equal or around the same skill level play. One chooses pichu the other marth who is most likely to win? No game is 100% balance and as long as two characters have one different move there will be a tier. Also there is no tier list for brawl. Tier list are mostly tournament results and the closest thing to at tier list for brawl is this.

Nothing but raw data.
I will never understand why smash casual players take such an offense at something that is generally commonly accepted on other gaming communities.

So if someone wins first place in a tournament among 1,000s of people and he used Bowser, people would say "he's top tier. He's very effective in fighting." It's totally retarded and tiers are for queers.
In melee there was a player name Gimpyfish who placed high and won many tournaments with bowser and is highly respected. Guess what? Bowser is still low tier. Same thing happen to Ness and Link but they are still low tier.

I just played some pretty competetive brawls and realized(No offence) that really none of you guys are tourny level fighting. That's based on the people I've fought(You know who you are). I think I've fought almost everyone at least once... Yeah, I fought verycoolguy...
We have never played but that is because i detest wifi and it hardly proves any ones skill unless there is zero lag.
