That's a position they put themselves into when signing up. They willingly made the choice to become murders ... to become "The gears of war".

Well, thanks for calling my good friend, my third cousin, and my Opa murderers...

Being in the military isn't just about "killing" (which by the way it's either self defense during an attack or eliminating a serious threat in most cases), they have other priorities like rescue missions, giving aid in natural and national disasters (like from a tsunami, earthquakes, or I dunno... a terrorist attack), and several other duties if needed.

They don't kill because they think it's cool; they kill because they have to in a life threatening situation. That's part of being in a military. They're risking their lives because they are potentially bounded to be in a war or a battle for such and such reasons. Most people don't join the military to "kill people", they join because it's a paying job with benefits for them (especially the G.I. Bill if they serve long enough).

I'm not arguing that the officer broke the law, but what he did should be against the law. If the officer breaks a policy in their police department that results someone dying, then it's police brutality, and should be charged for manslaughter.

I'm not denying what the officer did was technically legal, but I think it should have been for that reason.

At 12/4/14 05:10 PM, HooglyBoogly wrote:
Against NYPD policy, and illegal, are completely different. While what he did was against the rules, it was not against the law.

That's sort of a problem I have with this policy. The police are sworn to follow the policies, and while I understand that sometimes they mess up on a minor offense, something like Eric Garner's death should be taken very seriously. The police are given a higher standard than citizens do because they are authorized to use force and deadly force (when the situation calls for it), so in this case, I feel if they killed someone out of policy (i.e. choke hold), then they need to be faced criminally.

I agree that he shouldn't have gotten the guy in a head lock. What I don't agree with, though, is that he should be charged with involuntary manslaughter (which is the most likely charge he would face in that scenario). He was following procedure that is taught at every police academy for subduing individuals larger than yourself.

Same as above, but I'll add that it's NYPD's stupidity to ban choke holds, because there can be situations when it calls for it. You're right, Garner's health is pretty bad, but again, the police broke a pretty serious policy.

Well tasers pose a heart risk, as well. Not to mention shooting one from very close range may have limited effect. The barbs on a taser need to be a minimum of several inches apart in order to have full effect. At such close range, they pose a risk of landing too close to each other which would limit the current to only a small area. (I have no idea why that is.) There's also the issue of baggy clothes which are a good preventive measure against getting zapped.

I'm speaking in regards of what's present in NYPD. Tasers are allowed, but choke holds aren't apparently. If they used tasers and that happened to kill them, then despite it being devastating, it doesn't violate anything because he was resisting anyway. The same thing would also be true if choke holds weren't banned by NYPD.

There's also pepper spray, but that could make Garner more mad and resistant than compliant.

In regards to distance, the officers can easily back up to the appropriate range for their tasers anyway.

Contrary to my previous post, I remain on the fence about this incident. Selling untaxed cigarettes is really a victimless crime that shouldn't be taken that seriously. At the least, it's not deserving of a whole squad of police officers showing up. On the other hand, I full suspect him of breaking the law, and was caught. He resisted, and was subdued. Albeit, not in the most humane method.

I understand the officers showing up to Garner because he had multiple offenses in the past. Even if it weren't violent offenses, if they got a tip that he's breaking the law again or if they caught him red handed, then they will obviously go see what's going on. Yes he did resist, but honestly, issuing a citation in this case would make a lot more sense. Garner only started to resist (correct me if I'm wrong) when the officers tried to place him under arrest.

EDIT: Fixed Grammar.
Response to: How Does NG Lean Politically? Posted 1 month ago in General

Holy crap! That's a lot of questions

1. What kind of economic system do you prefer? Free-market capitalism? Socialism? Somewhere in between?

Somewhere in between would probably make the most sense. Restrict too much, and the motivation for starting a business will die off, but giving them the freedom to do whatever we want, and we could be struggling to survive.

2. More regulation on corporate practices? Or less?

See above.

3. Higher minimum wage? Lower minimum wage? No minimum wage? If you do support a minimum wage, should it be constantly adjusted for inflation?

That's honestly a difficult question for me, and I really don't have an answer for.

4. What would you think about a "maximum wage" if it were to exist? If you would be for it, around what amount would you set it at?

No. There shouldn't be a maximum wage.

5. Pro-Life or Pro-Choice? Does it depend on the circumstance?

Pro-Choice, but only because of potential consequences of banning abortion entirely. I'm personally Pro-Life, but politically speaking I'm Pro-Choice (if that makes sense).

6. What kind of foreign policy do you prefer? Isolationist? Interventionist? Some moderate intervention when necessary?

Moderate intervention.

7. Marijuana: Legal or illegal?

Legal

8. Same sex marriage: Legal or illegal?

Legal

9. Same sex couples adopting: Legal or illegal?

Legal

10. Currently in the United States (and I'm assuming elsewhere) it is legal for an employer to discriminate based off of an applicants sexual orientation and/or gender identity, usually done on the basis of religious freedom. Do you think this should be made illegal? Kept legal? Do you think we should remove ALL discrimination laws, so employers have the freedom to hire and turn away whoever they want?

If it's wrong to discriminate based on someone's race and sex (and it is wrong), then it should also be wrong to discriminate based someone's sexual orientation. Religious reasons is sort of a mix bag, but religion was also used to discriminate against people who were not white.

11. How do you feel about Affirmative Action?

I would prefer Affirmative Action for those who are poor instead of race. That way, anyone who is poor, no matter what race, have an opportunity to improve their lives.

12. Should references to religion be allowed on our money, in our pledge, etc. and should people swear on a bible when testifying in court?

I'm not particularly against it, seeing that the majority of the citizens in the United States believe in a God. If the tables turn and we have more atheists, then that should be changed.

13. Should the theory of creationism be allowed in public schools?

ONLY if evolution was taught along side it, then they can decide which path to follow.

14. Should police be allowed to use racial profiling as a part of probable cause when stopping and frisking people without a warrant?

No. If they know the suspect they are looking for is white, black, Hispanic, Asian, etc., then that's one thing, but randomly doing so goes completely against the 4th Amendment.

15. What do you think about current airport security procedures? Too extreme? Appropriate? Not strong enough?

No opinion.

16. Do you think there should be a flat tax rate or a progressive tax rate?

Flat tax.

17. Do you think churches should be required to pay property taxes?

Yes.

18. Do you think citizens should be allowed to own guns? Are there certain types of guns they should not own? Should they be allowed to carry these guns (if only certain kinds) on their person in public?

Yes, and they should be able to buy most of them (I don't think anyone should own a rocket launcher to name a few exceptions). They should also be able to carry these weapons, but businesses should have the power to ban them on their premises if they choose so.

19. Do you think criminal background checks should be required when purchasing a gun? Mental background checks?

Absolutely.

20. What kind of procedures should be implemented to prevent further school shootings? More police officers in schools? Teachers being allowed to carry guns? College students being allowed to carry guns on campus? No guns being allowed at all on school property (aside from police officers)?

This is another difficult question, but I'm leaning towards having CHL holders being allowed to carry their concealed weapon on campus, because banning guns on property won't stop shootings as it has been shown time and time again with Columbine, Virginia Tech, and Sandy Hook.

21. Should someone suspected of terrorist activity be entitled to a trial before they are detained? Or treated as a criminal of war?

Depends on where they have been arrested. In our country, the trial should be given. Outside? It's more of a gray issue, but I still think they should be granted some sort of a trial.

22. Should corporations be allowed to donate as much as they want to political candidates? Should politicians be allowed to accept corporate donations at all?

Actually, I have this idea of where all candidates will be given a X amount of dollars through taxes instead of corporations donating to them. Of course, everyone would want to run in this case, so corporations can only donate to them during the primaries, but there should be a max that any candidate can receive.

23. Should the government subsidize any industries (agricultural, energy, medical research, etc)?

No opinion.

24. Should it be legal for teachers or parents to use physical punishment on children?

As long as it isn't excessive I think they should be (simple spanking or something along those lines).

25. Should the government pass a law protecting net neutrality?

Not sure on the issue.

26. Should corporations based in one country be allowed to outsource labor to another country? If so, should they be required to follow the same business practices as in the US (same minimum wage, health care coverage, etc)?

Yes, and they should cover the same practices like they do here.

27. Should products like tobacco, alcohol, prescription drugs etc. be allowed to be advertised the same as any other product?

Sure, as long as warning labels are present.

28. Should food companies be required to label their products if they contain GMOs (Genetically Modified Organisms)?

We should be allowed to know what they add to our foods.

29. Should United States Supreme Court Justices (or the equivalent in other countries, if there is one) have term limits?

Not sure.

30. Should there be legal consequences if a politician is caught blatantly lying to the public, either in a political campaign commercial, a debate or an public speech or address?

That is such a gray area. It all depends on what the politician is lying about. Problem is, most if not all lie in some way.

31. Should there be legal consequences if a news source is caught knowingly reporting false information, or doing an irresponsibly small amount of research before reporting?

No. That's part of Freedom of Speech and Freedom of the Press. Plus, they could have messed up on their research and didn't mean to falsify it on purpose.

32. Should the government be able to monitor citizen's internet activity and phone conversations without probable cause for suspicion? With probable cause? Should that be considered admissible evidence in court?

Only with probable cause.

I ran out of room, so I'll answer this last one here...

40. What political party (if any) do you align yourself with?

Independent.

First off, Garner had a long rap sheet of repeated criminal activity. This is relevant because it typically dictates how the police are going to approach and/or handle you in a given situation.

The officer in question used a choke hold, which is against NYPD's policy. Regardless of this person's rap sheet (which were all nonviolent offenses), the police violated their own policy, and there should be more serious consequences than just surrendering their badge in a case like this.

More importantly, though, is that the autopsy report showed no throat damage to the victim. He died from a heart attack. The choke hold preventing just enough oxygen in his body to instigate cardiac arrest is an arguable statement due in part to his obvious unhealthy condition in the first place.

Didn't the autopsy ruled homicide? Even if it was a heart attack, there's still evidence to suggest (like you said) that there was enough pressure to block some of his oxygen flow to cause the cardiac arrest. Being charged with manslaughter would make sense in this case if not more. Also, if they really had to restrain them, couldn't they use their tasers?

For the record. From watching the video of the choke hold, and understanding NYPD's policy of choke holds, I am disappointed that the Grand Jury did not indict Officer Pantaleo with at least involuntary manslaughter.

When the Grand Jury transcript comes out, we may see why he didn't get charged.

One thing I will point out ahead of time; this happened before tasers were being used by police officers. Not sure if that would make much of a difference, but if the suspect didn't go down with pepper spray and continues to fight, then there's little options left.
