Yes, basically it's assault or battery because the slave is still considered a living thing. Technically, battery is when you hurt the person and inflict harm, and assault is when you threaten to hurt somebody when you're brandishing a weapon of some sort. So it'd be battery.

Most of us probably are aware of the hate crime shooting that took place in Wisconsin last year. On August 5, 2012, gunman Wade Page barged into the Sikh temple with a semi-automatic pistol and started pumping bullets at people inside the temple. Six Sikhs were killed, three others were wounded, and the rampage ended when Wade Page shot a police officer 15 times, critically injuring him. Another cop fired back, wounding Page. Page then turned the gun onto himself and committed suicide.
It was a disgusting act of anger, fear, and hate towards a certain religion. It happened hardly over a year ago, and the Sikh community of the U.S. will not forget an intense crime fueled by such hatred and fear.

If somebody commits theft or misdemeanor battery, then he or she will most likely be arrested and charged with the crime. It may suck for the defendant, but the defendant should have thought about what he/she did before the theft/battery occurred.
It's a similar concept to the BBS banning thing.
